Friendly Note to Fellow Members

I recently discovered, through the Copyright Act and the DMCA, that copyright applies even to free panels or shared works. That means reposting without permission, even a single element such as the panel image or gauges, is still considered copyright infringement. I thought it might be helpful to share this; it is always best to ask the author first before reposting, including on other sites.

Many of us (myself included) once thought that copyright didn’t really apply to free panels or shared works, since so many forums focus on free contributions and because they’re free. But in truth, copyright still applies, whether the work is free or paid.

Out of respect for each other’s effort:

  • 🙋 Ask the author before reposting.
  • 🔗 Give proper credit and the author’s link when sharing is allowed.
  • 🎨 Treat free panels with the same respect as paid ones.
  • 📩 If you find a panel you like but the download link is gone, it’s always best to reach out directly to the original author.
  • 🛑 Authors can request removal if their work is reposted without permission.

✨ I hope this reminder helps keep our community supportive and fair to all creators so that members can continue creating and sharing their work with ease.

If the moderator or admin feels this post isn’t off-topic, please feel free to take it down.

Note: I wasn’t posting this based on forum rules, but simply sharing what I discovered through the Copyright Act and the DMCA, a reflection I wanted to share, without opening further discussion.

Hi. Here is a panel design ready for you to finish yourself; you can place your own sensors anywhere and choose the size and font style. The panel is fully adjustable. If you’d like to download it, send me a message and I’ll share a Google Drive link to the file—free of charge, of course. It contains a large number of images and exceeds the forum's upload limit, so you can view it here:

Hi, I want to show you my last version of sensor panel, which I updated for my desktop computer from the default 2024-12-03f.sensorpanel. It is changed for my new 3rd 10" monitor with  1920 x 1280 resolution which I mounted inside my PC case. What do you think?

Copyright protection arises automatically upon creation of the work. This copyright lasts for a maximum of 70 years. This is inherent to the nature of the work, whether it be an oil painting, an embroidery, or a digital design.

Sharing a quick fact on copyright:

Copyright protection is automatic when a work is created; there's no need to spend money or mail yourself a copy. Registration can help enforcement, but it isn’t required. Sharing something for free doesn’t make it “open source” or give others the right to repost; the work remains copyrighted. Even on forums or other media, creators are entitled to enforce that.

In some cases, other forum and media admins have removed reposts of other people’s work, whether originally shared for free or sold, out of respect for copyright.

The law does allow individuals to create and share derivative works under certain conditions, but that doesn’t override automatic copyright, nor does it permit reposting without consent. It’s not a blanket permission to repost or redistribute someone else’s files.

Copyright law applies regardless of platform; posting on a forum or other media doesn’t strip rights. The only difference is enforcement: on a public forum, it’s harder to control redistribution, but copyright still exists.

This matters here because sensor panel designs are creative works, and copyright applies to them as well.

Just sharing what I know; end of note; no further discussion.

Oh my. Puleeeze. I am not a lawyer. Just goole it.

Not just calling you out Exhumed.

Yes. If it can be, and you actually copyright it. Go spend the money and try. At the very least; make a copy and send it to yourself via registered mail. Then hope for the best. Without spending cash, that is the best you get.

With all respect. If you guys are so worried about your IP, find a different and more secure platform. Jeeeeeeze.

These panels (files) are presented and posted as open source. Were is your protection within?

"Canada has a specific exception for non-commercial user-generated content, section 29.21 of the Copyright Act.

It says that an individual can use an existing work that has been made available to the public to create a new work, and can authorize an intermediary to disseminate the new work, provided several conditions are met.

The conditions include:

  1. The new work is used solely for non-commercial purposes.
  2. The source/author is identified where reasonable.
  3. The person had reasonable grounds to believe the original work wasn't infringing copyright.
  4. The new work doesn't have a substantial adverse effect on the original work's exploitation or potential market and isn't a substitute for it."

Let's analyze this concretely, since you believe you are right and I am wrong. Therefore, I asked Grok AI to compare both statements and determine who was right. Surprise. I already knew that, but since you insisted, here you go.

What Exhumed says (correct):

  • Copyright arises automatically upon creation (or fixation in a perceptible form) of the work — without registration, without formalities. This applies in all countries that have joined the Berne Convention (almost all, including the USA, Canada, EU, etc.).
  • The term of protection is, in most relevant countries (USA, EU, Canada, etc.), the life of the author + 70 years. For anonymous works, pseudonymous works, or “works made for hire,” it is often 95 years from publication or 120 years from creation (whichever expires first). The phrasing “maximum of 70 years” is a bit imprecise/abbreviated, but the core point (automatic + long duration) is correct.

This applies to oil paintings, embroideries, digital designs, etc., as long as they are original and fixed.

What the reply below says (mostly wrong or misleading):

  • One would have to “copyright it,” spend money, or send a copy to oneself by registered mail (“poor man’s copyright”). This is a myth. The registered-mail method has no legal effect and is not a substitute for registration. Registration is optional and provides advantages in some countries (e.g., USA) for lawsuits and damages, but it is not a prerequisite for the protection to arise.
  • The reference to “open source” and the Canadian exception does not change the automatic protection of the original work.

The Canadian section (Section 29.21 of the Copyright Act) is correctly quoted:

There is indeed a specific exception for non-commercial user-generated content. An individual may, under certain conditions, use an existing work that has been made available to the public to create a new work and authorize an intermediary to disseminate it, provided that:

  1. it is used solely for non-commercial purposes,
  2. the source/author is identified where reasonable,
  3. the person had reasonable grounds to believe the original work was not infringing copyright,
  4. the new work does not have a substantial adverse effect on the original work’s exploitation or potential market and is not a substitute for it.

This is a real Canadian special rule (since 2012) that strengthens fair-use-like user rights for UGC. However, it does not override the automatic copyright protection of the original work and does not permit unrestricted commercial use or circumvention.

Conclusion: Exhumed is correct on the core point (automatic protection, long duration). The reply below mixes myths about “copyright registration” with a real Canadian exception and is inaccurate on the point it addresses. Depending on the context (platform, country, whether the files are actually under an open-source license), practical enforceability can still be difficult — but that does not change the legal foundation.

Off-topic discussion is now over. Please return to the actual thread topic: Share your sensor panels. :)

Please keep the discussion civil and on-topic.

We don't tolerate drama or pages of off-topic comments here. The primary purpose is to exchange sensor panels with other users and to find help with using the AIDA64 software and modifying/editing sensor panels. Many users and mods post tutorials and offer assistance when someone has questions.

Personal attacks, insults, and accusations against other members (or moderators) are not allowed.

Promotions belong only in the dedicated “$ Promote your SensorPanel $” thread. Free sharing is welcome in the Share thread – the premise of that thread is to share, modify and enjoy panels.

Repeated violations of forum rules may result in warnings or further action.
